Pursuant to article 13 of Legislative Decree 196 of 30/06/2003, otherwise known as the "Personal Data Protection Code", Golfera in Lavezzola S.p.A., in its capacity as Data Processing Controller is required to provide users with information about the processing of personal data.
SCOPE, NATURE, COLLECTION AND PROCESSING OF DATA
Golfera in Lavezzola S.p.A. undertakes to protect the privacy of users. This privacy disclosure describes the mechanisms for collecting and processing data used by the site http://www.golfera.it (hereinafter the "Site").
Persons accessing the Site consent to the collection and processing of their personnel data, according to the procedures described in this privacy disclosure. In particular:
- The disclosure only applies to the Site of Golfera in Lavezzola S.p.A., which may be accessed via electronic networks starting from the address http://www.golfera.it and does not apply to any other web sites consulted by the user via dynamic links.
- Golfera in Lavezzola S.p.A. does not own and does not intend acquiring and/or processing personal data, referred to the user, which is defined by law as "sensitive" and/or "judicial" pursuant to article 4, letter d) and letter e) of Legislative Decree 196 of 30/06/2003.
- The following types of data may be collected and/or processed:
- Data supplied voluntarily by the user. The user is free to provide the Data Controller with personal data. Optional, explicit and voluntary sending of personal data and email addresses to Golfera in Lavezzola S.p.A., and/or filling in electronic forms on the Site, to submit requests to use our services or concerning initiatives to receive information about our promotions, advertising materials, cost estimates and the supply of goods and/or services, if applicable, or to report complaints etc. will mean that we will acquire information about the sender"s address, as well as any other personal data included in the message and/or electronic form.
- Browsing data. The IT systems and software procedures used to operate the Site acquire some personal data, during the course of normal operations, of which transmission is implicit while using Internet communication protocols. This information is not collected in relation to identified individuals, but due to the nature of said, it may be used to identify users, through processing or referring the information to data held by third parties. This category of data includes: IP addresses or the domain names of computers connecting to the Site, URI (Uniform Resource Identifier) notation addresses of resources requested, the date and time of the request, other parameters relative to the operating system and IT platform, etc. In particular, as concerns the acquisition of the IP address, it is a number automatically assigned to the user"s PC when it connects to the Internet via an Internet Provider or from a company network using the same communication protocols. The IP address is used by IT systems to call up the pages requested during normal browsing on the web; Golfera in Lavezzola S.p.A. does not directly associate the IP address with a specific individual, as it is dynamically assigned by its Internet Provider or masked by the company firewall. The IP address varies each time an Internet connection is made and only the Internet Provider or the Company of the user can trace the actual person to which the IP address has been associated in previous connections. IP addresses are therefore anonymous data as they are not simply referred to a specific person and traffic data are only used to obtain statistics on use of the Site and to check its proper functioning and could be used to ascertain responsibility in the event of alleged computer crime to the detriment of the Site.
- Cookies. When you visit this Site you can browse the pages anonymously and access some information without disclosing your identity. Cookies are not used to send personal information, nor are any kind of “persistent cookies”, i.e. systems that trace users.
- Personal data, when connected to the web services provided by the Site (which is physically located with the hosting company LEA Internet S.r.l.), are processed at the offices of the data controller, using manual procedures (e.g. hard copies), electronic and/or telematic instruments. Specific security measures are adopted to prevent the loss of data, unlawful or improper use and unauthorised access.
- Personal data are only used for the following purposes:
- To provide a requested service;
- For marketing activities, with promotional and advertising material, sales information and offers concerning the services of our company also sent by email and/or fax.
Failure to provide all or part of the personal data, or sending inaccurate personal data required for the purposes indicated in point 1) may result in our company not being able to respond to the user"s requests when said data is necessary. The processing of relative personal data in this case does not require consent.
Providing personal data for the purposes indicated in point 2) is optional and no consequences will arise if the user does not consent to providing said data, apart from our company being unable to take actions to improve its service. The processing of relative personal data in this case requires consent.
- The user"s personal data are disclosed to third parties only if necessary. Save for notices issued in compliance with obligations required by law, regulations or EU legislation, collected data may be disclosed to entities or categories of entities such as: public authorities and institutions, IT and company consultancy companies, external professionals and/or service and consultancy companies (providing for example accounting, tax, legal services and consultancy etc); other suppliers of goods and/or services necessary to respond to the requests of the requesting party, companies operating in the transport sector and entities granted the right to access data based on provisions of subordinate laws and regulations.
- The categories of entities which, in their capacity as Data Processors, may be notified of personal data within the framework of their respective functions and in compliance with instructions received, are the company"s personnel and/or outsourcers specifically authorised to process said data to achieve the purposes indicated above and for maintenance operations on the IT system.
- Users" data are not disseminated.
- Personal data could be disclosed to investigate, prevent or take legal action concerning unlawful activities, alleged fraud and situations which could represent a risk to the safety of persons, breach of the Terms and Conditions of our Web Site or in any other circumstance requested by the authorities.
RIGHTS OF PEOPLE INVOLVED
Pursuant to article 7 of Legislative Decree 196/2003, subjects which personal data refer to are entitled, at any time, to obtain confirmation of the existence of their personal data and to know their contents and origin, check the accuracy and request that said data are integrated, updated or rectified.
Pursuant to the above article, the people involved may request that data processed in breach of laws are erased, made anonymous or blocked and may also object to the processing of said data, on legitimate grounds.
